Welcome to the website of the American Chamber of Commerce in Taiwan (“AmCham Taiwan”, “AmCham”). Please read the following terms and conditions relating to your use of the AmCham website carefully. By accessing and using the AmCham website, you agree to be bound by these terms and conditions of use.
These terms and conditions apply to your use of all sites and services owned or operated by AmCham, including www.amcham.com.tw and all its web pages, sub-domains and digital properties. Unless otherwise stated, all references to the AmCham website in these terms and conditions include all such web pages. These terms and conditions do not apply to your use of unaffiliated sites to which any part of the AmCham website may link.
AmCham reserves the right to modify these terms and conditions at any time. You should check these terms and conditions periodically for changes. If at any time you choose not to accept these terms and conditions of use, please do not use this website.
Access to and/or use of the AmCham website currently is free to all members of the public. AmCham reserves the right to charge for access to and/or use of its website in the future.
Restrictions on Use of Materials
The contents of the AmCham website (including, but not limited to text, photographs, graphics, video and audio content) are protected under the copyright laws of the Republic of China (Taiwan) and other countries, and is the property of AmCham or the party credited as the provider of that content. You must abide by all copyright notices and restrictions on use.
By sending content to AmCham via our website, you are giving AmCham the right to display such content on its website and its affiliated publications and to use such content for promotional and marketing purposes.
You may access the materials located within the AmCham website only for your personal use. This means that you may download and save one copy of posted materials on a single computer for personal, non-commercial home use only, so long as you neither change nor delete any author attribution, trademark, service mark, or copyright notice.
You may not modify, copy, publish, sell, display, transmit, distribute, create derivative works, or in any other way use or exploit the content of the AmCham website.
Copyright Matters
We respect the intellectual property rights of others, and expect that people who use the AmCham website to do the same. To notify us of an alleged copyright infringement found on the AmCham website, please contact us with the following information:

Miscellaneous
These terms will be governed by and construed in accordance with the laws of the Republic of China (Taiwan), without regard to any principles of conflicts of law. You agree that any action at law or in equity that arises out of or relates to these terms will be filed only in courts located in the Republic of China (Taiwan), and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any of these terms and conditions are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions.
Consent to the Collection, Processing and Use of Personal Data
To comply with the Personal Data Protection Act (the “PDPA“) and to protect member’s interests, the American Chamber of Commerce in Taiwan (“AmCham Taiwan“) hereby informs member of the following pursuant to the PDPA upon collecting and processing member’s personal data:
- Purpose of collection and processing: AmCham Taiwan collects and processes member’s personal data for purposes of contract, quasi-contract, or other legal relations between the parties; consumers and customers management and services; information (communication) and database management; information (communication) security and management; online shopping and other electronic business services; advertisement and business activities management; investigation, statistics, and research analysis.
- Classification of personal data: Information such as name, title, office address, contact phone number, fax, email address, mobile phone number, sex, date of birth, citizenship, identification number, passport number, registration number, category of membership, records of membership, account of financial institute, credit card / debit card number, the amount paid / received, details of the goods or services, and nature of business (the personal data listed therein are not exhaustive and shall be subject to the personal data actually collected by AmCham Taiwan). The listed personal data belongs to categories of personal identifiable information, financial identifiable information, government identification information, personal features, professional membership qualifications, goods or services obtained (provided) by data subject, financial transactions, data subject’s business activities, agreement or contract, and/or data unclassified.
- Time period, territory, target and way of the use of personal data:
- Time Period: The personal data may be used for as long as the specific purposes of collecting personal data remain valid, or years of storage prescribed under the applicable law or contract, or years of storage necessary for the performance of business of AmCham Taiwan (if longer than the period prescribed under the applicable law or contract), or the longer period otherwise agreed to by a member in writing.
- Territory: Within the territory of Taiwan, places where AmCham Taiwan’s overseas affiliations are located, places of the overseas offices or business premises of the third party appointed by AmCham Taiwan or AmCham Taiwan’s domestic or overseas affiliations, and areas covered for achieving the specific purposes set forth in Article 1.
- Target: Including AmCham Taiwan, its domestic or overseas affiliations, and the clients and employees of AmCham Taiwan and its domestic or overseas affiliations, the domestic and overseas affiliates of the third party appointed by AmCham Taiwan or its domestic or overseas affiliations, as well as persons covered for achieving the specific purposes set forth in Article 1.
- Way of using personal data: In a way that facilitates the achievement of the specific purposes set forth in Article 1, including but not limited to computer processing, mailing, fax, etc.
- Rights members have and way of exercising the rights: In the manner specified by AmCham Taiwan, members may request a review of the personal data and to make duplications of, supplement or correct, discontinue collection, processing or use of, and delete the personal data, provided a fee is payable.
- Impacts of refusing to provide personal data: Members are free to choose whether to provide the abovementioned personal data. However, the exercise of membership rights might be affected if a member chooses not to provide relevant personal data.
- For the need of business operations or management, AmCham Taiwan or its affiliations may from time to time request members to provide their personal data other than those specified in Article 2 for purposes outside the specified purposes indicated in Article 1. The member agrees to cooperate with AmCham Taiwan and provide necessary assistance, including but not limited to giving written consent and signing relevant documents. AmCham Taiwan is not required to pay any fee for the above.
- If the personal data provided by a member is proven, as reported or found, to fail to conform to the member’s true identity or to be falsely claimed or obtained through theft of another person’s personal data, AmCham Taiwan is entitled to terminate all contractual relationships and claims resulting in damages.
- Effect of this Consent is equivalent to that of the written consent set forth in Subparagraph 5, Paragraph 1 of Article 19 of the PDPA.
- Members agree that AmCham Taiwan shall have the right to amend the “Consent to the Collection, Processing and Use of Personal Data” and members further agrees that AmCham Taiwan may provide members with a summary of the amendments verbally, in writing, by telephone, text message, email, fax, electronic document, or in other manner that adequately keeps members informed or enables members to be informed of the above, or forward the summary to members in the above manner.
Commitment to Compliance
The American Chamber of Commerce in Taiwan (AmCham Taiwan) is committed to complying in its operations with all applicable laws, including, but not limited to, Taiwan’s “Act to Implement the UN Convention Against Corruption” which came into force on May 20, 2015. Beyond complying with all legal requirements, AmCham Taiwan pledges to conduct its business in accordance with the highest levels of honesty and integrity, including its interactions with government officials and business enterprises.
Each officer, director and employee of AmCham Taiwan is expected to act in good faith and with integrity in the performance of their responsibilities on behalf of AmCham Taiwan and to report any indications of illegal or improper conduct.
Policy against Bribery and Corruption
It is the AmCham Taiwan policy to prohibit bribery and other corrupt conduct in any form by the Chamber or any representative acting on behalf of the organization. Bribery and kickbacks involving government officials, customers, suppliers and other counterparties in the commercial marketplace are specifically prohibited.
Accordingly, AmCham Taiwan and its representatives may not, directly or indirectly, offer, promise, pay, give or authorize any financial or other advantage, or anything else of value, to any other person or organization, with the intent to exert improper influence over the recipient or induce the recipient to violate their duties.
Policy Against Harassment
AmCham Taiwan prohibits harassment of any kind in the workplace, including sexual harassment, and has published the Sexual Harassment Prevention, Complaint and Investigation Policy (Policy) and formed an Anti-sexual Harassment Committee. AmCham Taiwan will take appropriate and immediate action in response to complaints or knowledge of violations of this Policy. For purposes of this Policy, harassment is any verbal or physical conduct designed to threaten, intimidate or coerce an employee, co-worker or any person working for or on behalf of AmCham Taiwan.
